What Causes Cerebral Palsy?

Cerebral palsy can be caused by abnormal development of the brain or damage to the developing brain. According to the Centers for Disease Control and Prevention, about 85 percent to 90 percent of CP that is caused by damage to the brain that occurs before or during birth. Trauma or lack of oxygen to the brain due to medical mistakes sometimes causes cerebral palsy.

Failure to properly diagnose and treat jaundice can also lead to CP. Left untreated too long, jaundice can develop into kernicterus, which can cause cerebral palsy and other conditions.

Did Medical Malpractice Cause Your Child’s Cerebral Palsy?

Not every case of cerebral palsy is caused by medical malpractice. Our birth injury attorneys are experienced in examining medical records to determine whether medical mistakes caused or contributed to the development of your child’s CP.

One of the first steps we take is to check for:

The presence of all four of these factors strongly indicates that the baby suffered oxygen deprivation, also called fetal hypoxia or birth asphyxia, shortly before or during labor and delivery. Next, we check the fetal monitoring strip to look for indications of birth trauma such as unusual heart rhythms.
