Are Insurance Companies Ignoring Your Attorney’s Demand Letters?

Seeking compensation for one’s personal injuries after an accident can be challenging. That’s why demand letters exist; they are prepared by one’s attorneys and are typically issued to at-fault parties and their insurance companies. In these letters, they contain information such as the circumstances of the accident; reasons that explain why the insurance company’s client…Read More

Head and Spinal Cord Injury Lawyers in New Jersey

Experienced Motorcycle Accident Lawyers at Team Law Help Client Suffering with Head & Spinal Injuries across New Jersey

Motorcycle riding is fun and exhilarating; there is no question that those who love the two-wheeled mode of transportation believe it’s the best way of getting from here to there – or anywhere! Savvy bikers also know that other motorists somehow seem to always fail to “see” them on the road. With that knowledge, and the fact that a motorcyclist has little to no protection against the elements while riding, experienced riders take safety precautions to protect themselves against careless drivers of cars, trucks and buses.

It’s especially maddening, then, when a car or truck driver causes a motorcycle accident due to distracted driving, drunk driving or simply failing to follow the rules of the road (careless and reckless driving.) Accidents in Hudson, Middlesex, Union and Essex counties often result in brain trauma, spinal cord injuries and other catastrophic injuries for the motorcyclist.

If you or someone you love is suffering from a traumatic brain injury (TBI), spine, head or neck injury after a motorcycle collision, contact the skilled personal injury lawyers at Team Law today for sound advice about your legal options. We offer free consultations and there are no upfront legal costs to be paid by you or your family.

Head Trauma is the Most Common Motorcycle Accident Injury in Clark, Jersey City and Plainfield, NJ

New Jersey law requires all motorcyclists to wear a helmet when riding. However, helmets and other safety precautions provide little protection for the biker in any type of motorcycle accident. This is simply because a motorcyclist isn’t surrounded by tons of steel, nor is a biker equipped with airbags and seat belts. On impact in an accident, a biker commonly either flies over the handlebars, gets dragged along the roadway or gets crushed between the bike and other vehicle. Head injuries, especially traumatic brain injuries, are the most common reason for wrongful death as well as permanent disability following a motorcycle crash in Irvington, Rahway, New Brunswick, Summit, Westfield and all across New Jersey.

TBIs are most often caused when the biker’s head hits the pavement or other stationery object. However, serious brain injury can result from the brain moving back and forth in the skull, too. This action can result in both minor and severe concussions, whiplash, and other extremely serious injuries (hemorrhages or hematomas which are serious brain bleeds) that often require surgeries, hospitalizations, rehabilitation and more.

It’s not uncommon for TBIs and other head injuries to leave the injured motorcyclist with lasting painful symptoms that will have a major impact on quality of life. A TBI victim may be unable to walk, feed themselves, breathe without machines and otherwise live independently.

What are the Symptoms of a TBI Caused by a Motorcycle Crash?

It’s not uncommon for TBIs and other head injuries to leave the injured motorcyclist with lasting painful symptoms that will have a major impact on quality of life. A TBI victim may be unable to walk, feed themselves, breathe without machines and otherwise live independently.

According to the Mayo Clinic, there are three levels of traumatic brain injury: mild, moderate and severe. As the labels suggest, an accident victim suffering from a mild TBI (also called concussion) may black out for a very short period of time. They may have headaches, nausea, dizziness or blurry vision. With a moderate TBI, loss of consciousness could last up to a few hours. Other signs of a moderate level TBI include confusion and difficulty concentrating as well as other physical and behavioral challenges.

While some moderate TBIs result in permanent injuries for a motorcyclist, this is more common with severe TBIs. Coma is common, as is wrongful death. Survivors of motorcycle crashes with serious brain injuries may have trouble for the rest of their life with even the simplest tasks of daily living including eating, drinking, walking, etc. Sight and hearing may be severely compromised. Emotional and mental impairments are common with severe TBIs, as well.

What Happens When the Spinal Cord is Injured in a Motorcycle Accident?

If your spinal cord (or cervical spine – neck) are injured in a motorcycle accident, you can lose all feeling in your body below the injury. If the injury is in your mid to lower spine, you may experience paraplegia. This type of partial paralysis will prevent you from having feeling and use of all or some parts of your torso, legs and pelvic organs. If your injury occurs in the neck region or upper spine, you may very well lose all feeling below the injury. This is referred to as “complete paralysis” or quadriplegia. If this injury occurs, you entire body, including torso, legs, arms, hands, feet, pelvic organs, etc., will be impacted.

Following any TBI or Spinal Injury, a Motorcyclist May Also Experience:

  • Depression, anxiety or anger
  • Trouble sleeping
  • Decreased cognition
  • Memory loss
  • Paralysis (full or partial)
  • Seizures
  • Wrongful death

What to Do After a Motorcycle Accident?

It’s critical to be examined by medical professionals immediately after a motorcycle crash. Even if you, the motorcyclist, is lucky enough to walk away from the accident, it’s important to note that brain, head, neck and spinal injuries sometimes don’t become obvious until hours, days, weeks or even months after the accident.

However, in order to prove fault in any accident, which enables us to hold the other party responsible for your accident and get you the justice you deserve, we need to preserve any and all evidence as soon as possible following the crash.

Depending on the severity of the TBI, the injured person may have to undergo surgeries, physical therapy and counseling for Post-Traumatic Stress Disorder (PTS) and other emotional challenges following a serious motorcycle accident.

Treatment for TBIs and other serious motorcycle accident injuries can be extremely costly. In fact, a report put out by the National Foundation of Brain Research revealed that the average amount of money spent on caring for a TBI patient is about $151,000. With the cost of healthcare rising exponentially annually, the financial burden on the victim’s family may be staggering.

If the accident victim requires extensive surgeries and medical intervention and/or long-term care, your family will need financial assistance in paying for these medical necessities. Further, if your loved one is injured to the point where they can no longer earn a living, you may be entitled to money to cover medical treatment, pain and suffering, rehab and long-term care and lost future wages to pay for living expenses.
