In the category of “accidents happen, here are two tremendously upsetting stories that left victims’ loved ones in mourning. The commonalities between these accidents that occurred a week apart is that they were both in Brooklyn and both the result of mishaps on construction sites.
First, a Flatbush man, 44, fell at least 30 feet on a Brooklyn construction site where he was working on March 26. He died after suffering serious head injuries. Apparently, according to police reports, he was standing on a ladder and slipped and fell.
A week later, another construction worker, 54, fell six stories to his death in Brighton Beach. Preliminary investigations showed this fatality was the result of an accidental fall off a scaffolding.
In the cases of these two fatalities, there is no reason to think that anything was particularly dangerous – more than the work itself. Construction site work can be fraught with safety hazards. Workers must stay vigilant; always wear helmets and appropriate steel-toed footwear. All hazardous situations must be reported to the site supervisor immediately and rectified.
If you or someone you love gets hurt at a construction site, you cannot sue your employer. Instead, you can file for Workers’ Compensation benefits. You will receive medical treatment and replacement pay. Depending on your injuries, you may be entitled to a cash award. In the cases of both men who were killed last week while at work on construction sites, their families may have claims and are entitled to receive death benefits.
In addition to Workers’ Compensation benefits…THERE MAY BE AN OPPORTUNITY TO HOLD ANOTHER PARTY RESPONSIBLE FOR YOUR INJURIES. For example, if the ladder you are standing on collapses causing your fall, you may have a lawsuit against the manufacturer of the ladder.
