What to Do Immediate After a Car Accident

If you find yourself in a car accident, there are a few things to do as soon as possible.

  1. Check for injuries. Check yourself and your passengers first, then see if anyone else has an injury.
  2. Call the police. If there are injuries, call 9-1-1. If no one is hurt, you’ll still want to call the police. But you can use a non-emergency number instead of 9-1-1.
  3. Do not hold up traffic. If the accident is minor, move the vehicles away from the flow of traffic.
  4. Exchange contact and insurance information. Take a cell phone photograph of the driver’s license and insurance card to save time.
  5. Find evidence. Without endangering yourself, take pictures of the damage to the vehicles and the accident scene. These pictures could be useful evidence in a future lawsuit.
  6. Let your car insurance company know about the accident.

Working with Car Insurance Companies

Even if you don’t intend to file a claim, let your car insurance company know of the accident. You can contact them directly or notify your insurance agent about the accident.

A failure to report your accident to your insurance company could result in your insurance company deciding not to cover you for any liability or damages you might have.

If the other driver’s car insurance company contacts you, be very careful when talking to them. They do not care about you, only themselves and the other driver. Ideally, avoid talking to them at all.

When it comes to your insurance company, you shouldn’t ignore them. To maintain your insured status, you have a duty to cooperate with the investigation into the accident. However, the investigation isn’t always in your best interest.

If you think your insurance company is no longer on your side, talk to our Elizabeth car accident lawyers. They can make sure you don’t do anything to risk your coverage or get into any legal trouble.

Hiring Our Elizabeth Car Accident Lawyers

Your car insurance company should be on your side. Your car insurance policy promises to provide a legal defense if you get sued. So why do you need your own attorney?

For one, what’s in your best interest and the insurance company’s best interest isn’t always the same thing. You want your insurance company to pay for anything you might be liable for. They want to spend as little money as possible.

Most of the time these interests work together, but sometimes, they don’t. When there’s a conflict, it helps to have a lawyer on your side.

Two, you want to sue the other driver. You can’t rely on your car insurance company to do this for you. You also can’t assume the other driver’s insurer will pay what you deserve for your injuries and damaged vehicle.

Even if the other driver’s insurance pays up, they may not pay enough to fully compensate you. So then you have to sue the driver. You’ll want one of our Elizabeth car accident lawyers to help you with this.

About Elizabeth, NJ

Elizabeth is a city located in Union County, New Jersey. The county seat of Union County and its largest municipality, Elizabeth is, as of the 2010 Census, the fourth largest city in New Jersey, behind Paterson; in 2018, the Census Bureau estimated that Elizabeth had grown to be the country’s 215th most populous city. Elizabeth was settled by English settlers beginning in 1664; the area was named for the wife of Sir George Carteret, one of the two original Proprietors of the colony of New Jersey. Elizabeth served as the first capital of New Jersey and was the site of several battles during the Revolutionary War. The current city of Elizabeth was created in 1855 from the merger of Elizabeth Borough and Elizabeth Township. Beginning at the turn of the 20th century, Elizabeth became a major economic and industrial hub, hosting manufacturing facilities for the Singer Sewing Machine Company and the Electric Boat Company (builder of submarines for the U.S. Navy).

Frequently Asked Questions About Car Accidents in Elizabeth, NJ

What steps do I take immediately following a car accident?

If you have been involved in a car accident, there are steps you can take to protect your legal rights and options for compensation. First, after making sure that everyone involved in the accident is receiving medical attention if they need, you should take photos of the accident scene. These photos may later be used to demonstrate how the accident occurred and who was at fault for the accident. You should also seek medical attention for yourself soon after your accident, even if you do not feel like you were hurt; this can help you later demonstrate the injuries that you suffered in your accident. Finally, you should speak with our experienced auto injury attorneys in Elizabeth, NJ, who can work on your behalf to protect your rights to compensation.

What types of compensation can I recover in a car accident case?

Medical expenses, rehabilitative costs, surgical costs, prescription drug costs…basically, any financial outlay related to treating the injuries you sustained in the car accident can be recovered as “economic damages” in your case. Other economic damages include lost wages or salary. We will also pursue a claim for “non-economic damages” for your pain and suffering, emotional distress and loss of enjoyment of life if appropriate in your case. Every car accident claim is different, so the available compensation will depend upon what happened in your case. Punitive damages may be available in especially severe car accident cases.
