Construction Site Accident

Team Law attorneys acted as lead counsel in a case involving three construction workers who were injured during the collapse of a temporary sidewalk bridge. At the time of the accident, they were discussing whether to suspend work for the day because of an unusually severe windstorm. The sidewalk bridge was intended to shelter anyone on the sidewalk during the demolition of the building. Team Law hired construction engineers to prove that the sidewalk bridge was improperly designed and worked with computer engineers to prepare a video animation demonstrating how a few minor changes would create a structure that could withstand a “once in a 100 year windstorm.
Medical Malpractice
$5.6 Million Verdict
Team Law’s client fell and dislocated her knee, causing an injury to the popliteal artery that ultimately resulted in the amputation of her leg. Suit was filed against the hospital to which she had been taken by ambulance, the emergency room doctor, a radiologist and an orthopedic surgeon. The orthopedic surgeon claimed he was inordinately delayed getting to the hospital because of traffic problems on the Garden State Parkway. Team Law was able to counter the surgeon’s testimony by obtaining records from the Garden State Parkway that showed no traffic problems and by obtaining the surgeon’s EZ Pass records. The claim against the emergency room doctor was that he should have asked for vascular consultation when he detected a weak pulse in the foot, not just an orthopedic consult. The claim against the radiologist was that his actions also delayed treatment. After a seven week trial, a verdict was entered in favor of Team Law’s client and against all four of those defendants.
Scaffolding Collapse
$5.45 Million Verdict
Team Law attorneys represented the owner of a demolition company who was standing under a scaffold that collapsed, causing comminuted fractures of his thigh that left him with leg shortening and a limp. The company that erected the scaffold claimed that it collapsed because an employee of the demolition company was dismantling it at the request of our client. The scaffolding company produced the former demolition company employee as a witness. The former employee testified that he had removed the bolts securing the main crossbeams prior to the collapse. Team Law was able to neutralize his testimony by demonstrating that he had been fired for alleged theft, was addicted to drugs, had contacted the scaffolding company after he was fired and had private dinner meetings with representatives of the scaffolding company on a number of occasions. In addition, a close-up analysis of photographs taken after the collapse revealed that the bolts securing the main crossbeams were still in place.

Howard Wiener recovered $600,000 for a 14-year-old disabled boy who was injured on a school field trip to an indoor rock climbing center. He was provided a harness by an employee of the rock climbing center. When it was his turn to climb the wall another patron of the rock climbing center connected a safety wire to his harness. When the boy was climbing down the wall the clasp released and he fell to the floor. As a result of the fall he sustained a left distal radius and ulnar styloid comminuted displaced fracture, a malunion of the left distal radius fracture, and a lumbar compression fracture. He underwent a closed reduction on his left wrist.
Rear-End Accident

Andrew Prince recovered $375,000 for a driver of a motor vehicle that was struck in the rear on Route 9 in Ocean County while stopped and waiting to make a left turn. The client, a 68 year old man, was taken to the hospital and underwent an open reduction internal fixation to repair a blowout fracture of his orbital bone sustained by the airbag striking his face. He also sustained disc herniations in his lumbar and cervical spine as a result of the accident and underwent epidural steroid injections in each. An EMG revealed cervical radiculopathy. The Defense argued that these changes in his spine were due to his age (degenerative) and not caused by the accident.

The injured 44 year-old worker was employed as a pipe maintenance employee in a factory when a clamp burst and he was sprayed with scalding water, resulting in second and third degree burns over 75% of his body, in addition to post-accident emotional injuries related to both flashbacks of the accident and residual scarring from the burns. Team Law litigation attorneys were able to couple the injuries sustained in the burn accident with previous injuries sustained by the injured worker to involve the New Jersey Second Injury Fund, and the burn victim was found totally and permanently disabled with an award of $319,000 for the first 8 years of disability, plus the opportunity to collect ongoing cash benefits in the future should his inability to return to work continue. The injured employee was also entitled to lifetime medical benefits for the injuries sustained in the accident as part of the agreement resolving the case.
Motorcycle Accident

Andrew Prince recovered $275,000 for a 38 year old driver of a motorcycle on Route 21 in Belleville when a truck driving on the other side of the highway struck the concrete median, causing a piece of the median to fall and strike him, which knocked him off of his motorcycle. Mr. Prince, with the help of a private investigator, was able to identify the owner of the truck, which had driven away. The client underwent two surgeries: one to repair a subacute fracture of the scaphoid wrist and the other to repair a dislocated toe.

Andrew Prince settled a case for $235,000 for a client who was struck by a vehicle while riding his motorcycle in Cranford, NJ. The driver that struck him went through a red light. As a result of the accident the client sustained injuries to his wrist and knee. He underwent an open reduction internal fixation with a volar plate to repair a left distal radius fracture and a carpal tunnel release. The other driver contended that she had a green light and had the right of way, not the client.

Tractor-Trailer Accident
