Frequently Asked Questions About Personal Injury Claims In Highland Park, New Jersey

How does New Jersey treat cases where more than one person is at fault for an accident?

New Jersey follows what is called “modified comparative fault” laws in certain situations where there is shared fault for an accident. Under the Garden State’s modified comparative fault laws, an injured person’s compensation for an accident will be reduced by a percentage that directly reflects their level of fault for the accident. Here is an illustrated example of how these laws work: if, for example, it has been determined by the New Jersey courts that the injured person was 20 percent responsible for their accident, then the damage award that the injured person may recover for their accident injuries and other losses will be reduced by that same amount — 20 percent. If the damage award was $20,000, it would be reduced by 20 percent, to a $16,000 award. But in New Jersey, if the injured person is more than 50 percent responsible for their own accident, they cannot recover any compensation for their injuries and losses from the other at-fault party.

My loved one has had difficulty sleeping ever since their accident, and they are unable to fully perform their job duties as a result of the accident. Is there any kind of compensation for this?

Yes. Emotional pain and suffering and mental anguish — which may include anxiety, depression, and other conditions — are considered injuries when discussing personal injury claims. Unlike other injuries that are physical in nature and have a price tag to — such as surgery to repair a broken limb — emotional injuries do not have an exact price, but they are losses all the same. When pursuing a personal injury claim that includes this type of immeasurable loss, the New Jersey court will evaluate all the aspects of the accident claim and then assign a monetary amount to this loss that the court believes is appropriate.
